Patent granted in India to NOKIA SOLUTIONS AND NETWORKS OY

As per patent office journal dated 27/08/2021, patent number 375256 has been granted to NOKIA SOLUTIONS AND NETWORKS OY which is titled EMPLOYING REFERENCE SIGNALS IN COMMUNICATIONS.

The primary independent claim of this patent states a method for employing reference signal in communication that includes receiving signal on a communication channels via receiver and correlating the received signal and a first reference signal by a correlator wherein the correlation is performed over at least a fraction of symbols in the first reference signal to determine the correspondence between the first reference signal and received signal. This determines whether the first reference signal can be employed on the communication signal.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that the amended claims of the present invention consist of hardware elements to perform the functionality, such as receiver, correlator, processor, decoder and the like. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
