Patent granted in India to PANASONIC INTELLECTUAL PROPERTY CORPORATION OF AMERICA

As per patent office journal dated 08/10/2021, patent number 378216 has been granted to PANASONIC INTELLECTUAL PROPERTY CORPORATION OF AMERICA. which is titled WIRELESS COMMUNICATION DEVICE AND WIRELESS COMMUNICATION METHOD.

The primary independent claim of this patent states a method for controlling emission, used in a radiation terminal that includes acquiring at a processor of the radiation terminal, a user type of a current user then controlling, to reduce a default emission power. Further, acquiring the user type of the current user includes receiving, at the processor, a defined user type of the current user. Biological parameters of the current user are further collected at the processor and the user type of the current user according to the biological parameters is then determined at the processor. After this, the Biological parameters sent from a wearable apparatus are received at the processor. Further step is receiving a type signal sent from the wearable apparatus at the processor and acquiring the user type of the current user according to the type signal, sent after the wearable apparatus collects the biological parameters of the current user and the user type of the current type is determined according to the biological parameters. Controlling the radiation terminal to reduce its own emission power includes, if the radiation terminal is in a communication state, controlling, at the processor, to determine the emission power with a condition of satisfying a basic communication quality; and if the radiation terminal is in a standby state, controlling, at the processor, to determine the emission state with a condition of a minimum radiation value.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that if the present invention provides a technical solution to a technical problem and has a technical effect then the same cannot be considered to fall under the category of algorithm or computer program per se. In the light of such observation, the applicant submits that method claims are directed towards a technical subject matter of wireless communication methods in which, in a downlink individual control channel in a multiuser-MIMO mode, the overhead of notifications of other-user modulation information can be reduced. This further reduces the signaling amounts to be sent to the terminals; and therefore, said claims cannot be considered as computer programs per se or algorithms. The applicant also submits that method claims are enabled with physical features such as first communication counterpart device, second communication counterpart device and wireless communication device, etc. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.

Overall, this patent covers a wireless communication device for performing communication with a plurality of communication counterpart devices by multiuser-MIMO transmission. The wireless communication device includes an assignment information generation section which is configured for a first communication counterpart device to generate resource assignment information including a pilot stream index, a number of streams (Mt) in the multiuserMIMO transmission and an indication of a combination of modulation schemes of second communication counterpart devices that differs from the first communication counterpart device, and a transmission section which is configured to transmit the generated resource assignment information to the first communication counterpart device, characterized in that the assignment information generation section is configured to allocate the pilot stream indexes in ascending or descending order of a modulation multi-level number of the modulation schemes of the second communication counterpart devices. Further, each pilot stream index is a number equal to or smaller than the number of streams, and for the first communication counterpart device, the combination of modulation schemes of second communication counterpart device is indicated by arranging these schemes in ascending or descending order of a modulation multi-level number and using an index of the arrangement of the indication of the combination.
