Patent granted in India to QUALCOMM INCORPORATED

As per patent office journal dated 08/10/2021, patent number 378663 has been granted to QUALCOMM INCORPORATED which is titled A METHOD OF WIRELESS COMMUNICATION.

The primary independent claim of this patent states a method of wireless communication that includes receiving control region information comprising an indication of a bandwidth and associated frequency-time numerology of a common control region, and an indication of a user equipment, UE, specific subband of the common control region. Further, the bandwidth of the common control region comprises at least a portion of a system bandwidth; receiving user data, wherein the user data is received using a different portion of the system bandwidth from the bandwidth of the common control region and monitoring the common control region based at least in part on the control region information.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that if the present invention provides a technical solution to a technical problem and has a technical effect then the same cannot be considered to fall under the category of algorithm or computer program per se. In the light of such observation, the applicant submits that the amended claims, includes an inventive step in terms of technical advancement, such as, receiving control region information comprising an indication of a bandwidth and associated frequency time, numerology of a common control region, and an indication of a user equipment, UE, specific subband of the common control region, the bandwidth of the common control region comprising at least a portion of a system bandwidth; receiving user data, wherein the user data is received using a different portion of the system bandwidth from the bandwidth of the common control region. Further, the applicant also submits that the apparatus set forth in claims are implemented with the help of different structural components/ hardware features, such as, UEs including narrowband control region manager, memory, processor, transceiver, antenna and ECC module etc. and base station including narrowband control region manager, memory, processor, transceiver, antenna, base station communications module and network communications module.  Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.

In some cases, the common control region may be divided into subbands, and different UEs may be assigned to monitor different subbands. Unassigned UEs may monitor a default anchor subband.
