Patent granted in India to SABIC GLOBAL TECHNOLOGIES B.V.

As per patent office journal dated 15/10/2021, patent number 378988 has been granted to SABIC GLOBAL TECHNOLOGIES B.V. that is titled CATALYST COMPOSITION FOR THE POLYMERIZATION OF OLEFINS.

The primary independent claim of this patent states a catalyst composition for the polymerization of olefins. Further, the catalyst is produced using a metal-containing compound having the formula (I): MeRnX3-n (I) in which X is a halogen, Me is a metal of group III of Mendelejev’s Periodic Table of Elements, R is a hydrocarbon moiety comprising > 2 carbon atoms, and n is 1≤n<3, or a dimer of a compound of formula (I); and the average particle size of the catalyst as reflected by D50. Further, a hydrocarbon solution comprising a magnesium-containing compound selected from an organic oxygen-containing magnesium compound and a halogen-containing magnesium compound and  an organic oxygen-containing titanium compound. Further, a solution comprising a mixture of:  a metal-containing compound having the formula (I): MeRnX3-n (I) in which X is a halogen, Me is a metal of group III of Mendelejev’s Periodic Table of Elements, R is a hydrocarbon moiety comprising > 2 carbon atoms, and n is 1≤n<3, or a dimer of a compound of formula (I), wherein the metal-containing compound is selected from n-butyl aluminium dichloride, isobutyl aluminium dichloride, diisobutyl aluminium chloride, di-n-butyl aluminium chloride, sesquiisobutyl aluminium chloride; and  a silicon-containing compound of formula R’mSiCl4-m in which 0≤m≤2 and R’ is a hydrocarbon moiety comprising at least one carbon atom.

During the patent prosecution, the patent examiner objected to this patent under section 3(d) of the Indian Patents Act. The patent applicant responded to this objection by stating that the claimed invention does not pertain to mere forms/derivatives of known compounds. The applicant further submits that the present set of claims are novel and inventive over the features described under prior arts and that neither documents specifically described the process as used in the present invention. In particular the original claim include specific metal containing compounds (MeRnX3-n) having branched hydrocarbon groups which results in a catalyst particles within 0.5-4.5 microns, which in turn imparts enhanced performance to the catalyst, thus the process of the present invention is novel and not a mere use of any known process. Therefore, the present invention does not fall under section 3(d) of the Patents Act.

This patent falls under the category of Polymer Technology. Overall, this patent covers a nucleic acid sequence, comprising or coding for a coding region, encoding at least one peptide or protein comprising a tumour antigen or a fragment, variant or derivative thereof, one histone stem-loop and a poly(A) sequence or a polyadenylation signal. Furthermore, the present invention provides the use of the nucleic acid for increasing the expression of said encoded peptide or protein and its use for the preparation of a pharmaceutical composition, especially a vaccine for use in the treatment of cancer or tumour diseases.
