Patent granted in India to TELEFONAKTIEBOLAGET L M ERICSSON (publ)

As per patent office journal dated 03/09/2021, patent number 375519 has been granted to TELEFONAKTIEBOLAGET L M ERICSSON (publ) which is titled A SYSTEM AND METHOD HANDLING COMMUNICATION SESSIONS IN A COMMUNICATIONS NETWORK.

The primary independent claim of this patent states a method for handling a communication session in a communications network wherein a request to register the user terminal in the communication network is received at an Application Function Mode and sending a request message to a Policy and Charging Register Function. The request message includes an Access Point Name that identifies an Access Point used by the user terminal. A response message is received from the Policy and Charging Register Function that includes an indicator that further Emergency-Access Point. Further, a message is received from a user terminal to establish a communication session with a terminating node. The message identifies a non-emergency terminating node wherein if the indicator indicates that the Access Point is not an EmergencyAccess Point, the establishment of a communication session is allowed. Whereas, if the indicator indicates that the Access Point is an EmergencyAccess Point, the establishment of the communication session is rejected.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that if the present invention provides a technical solution to a technical problem and has a technical effect then the same cannot be considered to fall under the category of algorithm or computer program per se. In light of such observation, the technical problem of avoiding additional processing at the PCRF for configuring a list of IP addresses related to emergency APNs, solved by the present invention by providing a mechanism to prevent fraudulent use of emergency registrations in a communication network. The claimed technical solution prevents fraudulent use of an emergency registration by contacting the PCRF each time a user terminal attempts to establish a communication session. Moreover, the applicant also submits that the claimed invention is performed using hardware components/elements, which is clear from the perusal of the claim. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
