Patent granted in India to XIAOMI INC.

As per patent office journal dated 10/09/2021, patent number 376431 has been granted to XIAOMI INC. which is titled TRANSMISSION CONTROL METHOD DEVICE AND SYSTEM.

The primary independent claim of this patent states a method for controlling emission, used in a radiation terminal and includes acquiring at a processor of the radiation terminal, a user type of a current user if the user type of the current user is a user type that needs to reduce radiation then controlling, at the processor of the radiation terminal, to reduce a default emission power. The acquiring, at the processor, the user type of the current user includes receiving, at the processor, a defined user type of the current user. Biological parameters of the current user are further collected at the processor and the user type of the current user according to the biological parameters is then determined at the processor. Biological parameters sent from a wearable apparatus are received at the processor after the wearable apparatus collects the biological parameters of the current user and the user type of the current user according to the biological parameters is then determined, at the processor. Further step is receiving a type signal sent from the wearable apparatus at the processor and acquiring the user type of the current user according to the type signal, sent after the wearable apparatus collects the biological parameters of the current user and the user type of the current type is determined according to the biological parameters, wherein the controlling the radiation terminal to reduce its own emission power comprises: if the radiation terminal is in a communication state, controlling, at the processor, to determine the emission power with a condition of satisfying a basic communication quality; and if the radiation terminal is in a standby state, controlling, at the processor, to determine the emission state with a condition of a minimum radiation value.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that if the present invention provides a technical solution to a technical problem and has a technical effect then the same cannot be considered to fall under the category of algorithm or computer program per se. In the light of such observation, the technical problem of reducing radiation by not adapting the default emission mechanism of optimal signal for the user types that need to reduce radiation. In order to solve the above recited technical problem, the present invention provides a method, an apparatus and a system for controlling emission and the method is used in a radiation terminal. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
