Patent granted in India to Amazon Technologies Inc.

As per patent office journal dated 02/07/2021, patent number 370152 has been granted to Amazon Technologies Inc, which is titled ‘variants of files in a file system’. The primary independent claim of this patent states a method for assessing data stored in a file system in at least one computing device, maintained by a processor,  for various users wherein each of such file systems include various files and one folder. Further, each file includes a unique identifier and a respective reference to a primary data object stored in a data store. Further, a request is obtained to store a file in a file system in a computing device by a processor, from a corresponding user associated with one of the file systems and then a file corresponding to the file in one of the file systems is created. Further, in response to the request, a primary object corresponding to the file is stored in a data store. The file is encoded into a secondary data object and then stored in a data store. Further, a file variant with a reference of the unique identifier of the file and reference to the secondary data object  is generated  and stored in a data store.  Subsequently, a request to access the file is obtained from one of the corresponding  users. The secondary data object is referenced by the file variant and sent to the mobile computing device. Further, the primary data referenced by the file is sent to another computing device when the request to access relates to access by the other computing device.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating the latest CRI guidelines published by IPO on June 30, 2017 wherein it was stated that to decide the patent eligibility the invention as a whole has to be considered.  Furthermore, the applicant stated that the subject matter of the instant invention discloses a method for accessing data stored in a file system wherein the user can obtain access to a file in a smartphone, laptop at home, office workstation and any other computing device. Therefore, the present invention does not fall under the purview of section 3(k) when considered as a whole.
