As per patent office journal dated 06/08/2021, patent number 373403 has been granted to SAMSUNG ELECTRONICS CO. LTD which is titled DISPLAY APPARATUS AND METHOD OF CHANGING SCREEN MODE USING THE SAME. The primary independent claim of this patent states a display apparatus that includes a display unit, bendable by external pressure; a sensing unit installed in the display unit, to sense a bending direction of the display unit; and a controller to control a plurality of objects displayed on a screen of the display unit according to the bending direction, wherein the controller, based on the display unit being concavely bent with respect to a front surface of the display unit, move the plurality of objects toward a bending axis depending on the external pressure, control the display unit to display a Graphical User Interface (GUI) for selecting one of the plurality of objects, select an object overlapping with the GUI from among the plurality of objects at a time when the display unit which has been concavely bent with respect to the front surface of the display unit returns to its original state, and control the display unit to move and display the selected object to a center of the screen.
During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that the present invention is of technical nature and provides technical advancement over the cited prior art. Moreover, the amended claims disclose various structural components such as “display unit”, “sensing unit”, “controller”, that work in consonance with each other to achieve the desired technical result. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
