SAMSUNG ELECTRONICS CO. LTD. GRANTED PATENT FOR USER TERMINAL DEVICE AND CONTROLLING METHOD THEREOF.

Samsung Electronics Co. Ltd. filed a patent application numbered 8656/DELNP/2015 that is titled USER TERMINAL DEVICE AND CONTROLLING METHOD THEREOF. The patent has been filed in the field of Computer Science. This Patent Application has been granted as Patent Number 353088. This invention relates to a user terminal device. The device includes a display configured to display a screen including an object, a detector configured to detect a user drawing input which is input on the object or in an area surrounding the object, a controller configured to, in response to the user drawing input being detected, execute a program corresponding to the object and display, on the display, a screen where the user drawing input is processed as an input of the program. Accordingly, the operations of the user terminal device may be controlled conveniently.

During the Patent Examination, the Patent Examiner raised objections under Section 3(k) of the Patents Act, 1970 (as amended). It was pointed out that in the absence of any hardware features, and since the invention lies in the configuration of the controller to execute the program to detect and process the drawing input of the user, the subject matter of all the claims are performed by the computer and computer programming instructions and inventive step lies in computer program instruction, which is nothing but a computer program per se.

As a response, the Applicant submitted that the amended claims do not fall under the preview of Section 3(k) of the Patents Act. The invention provides a technical solution to a technical problem. The invention provides a user terminal device that displays a screen including an object and performs a control operation corresponding to a user manipulation regarding the object.
