During the patent examination, the Patent Examiner raised objections under Section 3(d) of the Indian Patents Act, 1970 (as amended).  It was pointed out that the subject matter of claims relates to a known process for the vapor phase conversion of ethylene to ethylene oxide which does not involve any synergistic effects.

As a response, the Applicant submitted that the invention deals with the problem of selectivity and activity decline of a silver-based ethylene epoxidation catalyst overtime through controlled modifications of size and distribution density of silver particles on an alpha-alumina carrier. Therefore, as the method/process is not known, the invention cannot fall under Section 3(d) of the Act.
