Glia Inc. filed a patent application numbered 542/DELNP/2015 that is titled COMPOSITIONS FOR THE TREATMENT OF DRY EYE SYNDROME. The patent has been filed in the field of Pharmaceuticals. This Patent Application has been granted as Patent Number 352218. This invention relates to compositions and methods for treating eye disease and disorders. More importantly, the invention offers a composition containing progesterone and techniques of dealing with ocular surface ailments and disorders by applying these compositions topically.
During the patent examination, the Patent Examiner raised objections under Section 3(d) of the Patents (Amended) Act, 2005 stating that certain Claims define a mere admixture resulting only in the aggregation of the properties of the components thereof. It is not clear if the combined agents act together to provide a technical effect that is greater than just the sum of the two or more agents alone, or whether the combination is, in fact, a mere juxtaposition with no interaction of the agents. Ratios of components are not disclosed in the principal claim.
As a response, the Applicant submitted that the disputed claims were pending cancellation, thus, rendering the objection moot. Further, the Applicant also amended the remaining claims, which now illustrate a pharmaceutical composition.
