Silver Future Co., Ltd. filed a patent application numbered 202015007684 that is titled ANTIBACTERIAL PRODUCT AND METHOD OF MANUFACTURING THE SAME. The patent has been filed in the field of Chemicals. This Patent Application has been granted as Patent Number 356969. This invention relates to an antibacterial product, comprising at least one antibacterial part, wherein the antibacterial part includes a sintered silver-containing surface layer, the sintered silver is silver obtained by sintering silver nitrate as a silver salt compound under a nitrogen atmosphere including nitrogen in an amount of 99 to 100vol% at a temperature of 440°C 10 to 1000°C and the antibacterial product is an antibacterial metal scrubber.
During the patent examination, the Patent Examiner raised objections under Section 3(d) of the Indian Patents Act, 1970 (as amended). It was pointed out that the compounds and processes as defined in the claims are not novel and inventive. In view of the compounds and process as mentioned in the prior art, the compounds and process of the present invention would be considered as “same compounds and same process” as per the clause/Act.
As a response, the Applicant submitted that a nitrogen atmosphere has the technical effect of significantly enhancing the antibacterial effect of the product. This antibacterial effect is much more effective as compared to the prior art, which suggests sintering the silver salt compounds under air i.e. an oxygen atmosphere.
