As per patent office journal dated 13/08/2021, patent number 373917 has been granted to INDOFIL CHEMICALS COMPANY (A DIVISION OF INDOFIL ORGANIC INDUSTRIES LTD) that is titled SYNERGISTIC FUNGICIDAL COMPOSITION.
The primary independent claim of this patent states a synergistic fungicidal composition comprising Mancozeb in the range of 50 to 85 percent of the total mass of the composition, Hexaconazole in the range of 2.5 to 10 8 percent of the total mass of the composition, one wetting agent in the range of 1 to 5 percent of the total mass of the composition, one suspending agent in the range of 1 to 10 percent of the total mass of the composition, one stabilizer in the range of 0.5 percent to 3 percent of the total mass of the composition, optionally, comprises fillers in the range of 1 to 20 percent of the total mass of the composition.
During the patent prosecution, the patent examiner objected to this patent under section 3(d) of the Indian Patents Act. The patent applicant responded to this objection by stating that the claims of the present disclosure are directed to fungicidal composition and that the learned Controller has not raised any novelty objections for claims indicating that the Controller acknowledges the novelty of said invention. Therefore, as the present disclosure is “new”, it cannot be “known”. Therefore, the present invention does not fall under section 3(d) of the Patents Act.
