Patent granted in India to DOW GLOBAL TECHNOLOGIES LLC

As per patent office journal dated 03/09/2021, patent number 375303 has been granted to DOW GLOBAL TECHNOLOGIES LLC that is titled PROCESS FOR PREPARING MULTI- OR DUAL-HEADED COMPOSITIONS USEFUL FOR CHAIN SHUTTLING

The primary independent claim of this patent states a process for preparing a composition, the process includes combining a linking group, an organometallic compound, a co-catalyst, a solvent, and a first catalyst precursor; wherein the organometallic compound comprises a trivalent metal, a divalent metal, or a mixture of a trivalent metal and a divalent metal; wherein the catalyst precursor is Catalyst (A1) or (A2) as listed below: Catalyst (A1): [N-(2,6-di(1-methylethyl)phenyl)amido)(2-isopropylphenyl)(α-naphthalen-2-diyl(6-pyridin-2-diyl)methane)]hafnium dimethyl] Catalyst (A2): (E)-((2,6-diisopropylphenyl)(2-methyl-3-(octylimino)butan-2- yl)amino)trimethyl hafnium and further obtaining a final solution comprising the composition, wherein the solvent is an aromatic solvent, and wherein the composition has the formula wherein: each MA is Al, B, or Ga; each MB is Zn or Mg; m is a number from 0 to 1; n is a number from 1 to 100; each J1, J2, and J3 is hydrogen or a C1-20 alkyl group, and wherein J1, J2, and J3 are the same or different, or mixtures thereof; and ZZ is a linear or branched C4-100 hydrocarbyl group that optionally includes at least one heteroatom, and wherein ZZ is aliphatic or aromatic, wherein the composition comprises a single derivative of the linking group, and wherein the linking group is an alpha-omega diene.

During the patent prosecution, the patent examiner objected to this patent under section 3(d) of the Indian Patents Act. The patent applicant responded to this objection by stating that the claimed process for preparing a composition defines novel and non-obvious technical features and therefore cannot be considered as a mere use of a “known” process as disclosed in the cited references. Additionally, the claimed method surprisingly and unexpectedly demonstrates single olefin insertion in that only one derivative of the linking group inserts in between the metal species. Therefore, the present invention does not fall under section 3(d) of the Patents Act.
