The invention covers chemical compounds. The invention relates to compounds of formula (I): R0 signifies a C1 to C4 alkyl group, R1 signifies CN or CONH2, R2 signifies a secondary or tertiary amino group, R3 signifies a secondary or tertiary amino group, BR is a bridge of the formula -A-B-A- wherein A is substituted phenyl or substituted naphthyl or unsubstituted phenyl or unsubstituted naphthyl, and B is a bivalent group of the formula -SO2-, -CONH-, -HNCO-, -SO2NH- or -HNSO2-, with the proviso that the compounds of formula (I) bear at least one anionic substituent.
During patent examination, the patent examiner raised objections under Section 3(d) of the Indian Patents Act, wherein the examiner stated that the claims 1-9 are a new form of known substance (other derivatives) in respect of the compounds disclosed by citations because no enhancement in the efficacy has been described in the description and hence, falls within the scope of Section 3(d) of the Indian Patent Act.
As a response to said objection, the applicant responded by submitting that molecular and structural components are different.
