EXXONMOBIL CHEMICAL PATENTS INC. Received a Patent for EMM-22 MOLECULAR SIEVE MATERIAL

Exxonmobil Chemical Patents Inc. filed patent application numbered 809/DELNP/2014 that is titled as EMM-22 MOLECULAR SIEVE MATERIAL, ITS SYNTHESIS AND USE. This Patent Application has been granted as Patent number 316400.

The invention covers chemical compound.  A molecular sieve material designated as EMM-22 has, in its calcined form, an X-ray diffraction pattern including the following peaks in Table 1.

 

During patent examination, the patent examiner raised objections under Section 3(d) of the Indian Patents Act that the said claims 1-11 and 14 of the present application attract the provision of section 3(d) of the Patents Act, which is already known from the cited prior art documents.

As a response to the said objection, the Applicant submits that the present invention recites molecular sieve material which does not fall within the category salt, ester, ether, polymorph, metabolite, pure form, particle size, isomer, mixtures of isomers, complexes, combinations and other derivatives of any known substance, as envisaged under Section 3(d) of the Act. Based on the differences in XRD patterns of the molecular sieve materials of the present invention and that of the prior art as explained with respect to the objection on novelty and inventiveness of the present invention, the applicant submits that the molecular sieve materials of the present invention is novel.
