GE Healthcare Bio-Sciences AB Received a Patent for Polymer Phase Systems

The invention relates to a process for enriching a target compound from a liquid, which process comprises at least one step of isolation performed by differentially partitioning between two aqueous phases. Thermally responsive, self-associating (ie, clouding) hydrophilic polymer, and if needed some additional salts, to an aqueous biotechnical solution (such as a fermentation sample or bioseparation process stream) Other conditions where the solution separates into a polymer, two-phase system with one phase enriched in the polymer. The target compound is in the process of being enriched in the polymer, while a significant but variable percentage of contaminants may be differentially partitioned to the phase interface or the enriched phase polymer.

During patent examination, the patent examiner raised objections under Section 3(d) of the Indian Patents Act that the claims 1 to 30 appear to be a mere use of a known process which neither results in a new product nor employs any new reactant.

As a response to the said objection, the applicant submits that the present invention provides a novel and inventive method of separation of isolating a target molecule (antibody) from an unclarified CHO broth by mixing a liquid mixture under certain conditions to form a one-polymer, two phase system where the target molecule partitions into the phase not enriched in the polymer at a specific concentration of salts.
