This invention relates to a continuous process for manufacturing methionine by alkaline hydrolysis of methionine hydantoin in the aqueous phase, removing NH3 and CO2 from the hydrolysis medium, and neutralizing the obtained methioninate salt, characterized in that, after removing NH3 and CO2, the hydrolysis reaction medium is concentrated to precipitate Na2CO3, said Na2CO3 being separated then recycled for alkaline hydrolysis, the latter being carried out in the presence of NaOH and Na2CO3.
During the patent examination, the patent examiner raised objections under Section 3(d) of the Indian Patents Act, 1970. It was indicated that the claims appear to be a mere use of a known process as disclosed in the cited prior art documents.
As a response, the Applicant submitted that the invention was held novel in the FER. Further, the inventiveness of the claims was demonstrated. Therefore, the claims do not fall under Section 3(d). Accordingly, the Learned Controller was respectfully requested to set aside the objection.
