During the patent examination, the Patent Examiner raised objections under Section 3(d) of the Patents Act, 1970 stating that the analytical method for analyzing the presence and quantity of impurities present in a preparation of dianhydrogalactitol as defined in the claims is a mere use of a known method which does not result in enhancement of efficacy of a known method (for improved analytical methods for dianhydrogalactitol and derivatives or analogs thereof).
As a response, the Applicant submitted that the claimed method provides an improvement over the analytical method of D1, for instance, a comparison of chromatographic results for DAG and its impurities. Hence, the subject matter of the claims should be held patentable.
