During patent examination, the patent examiner raised objections under Section 3(e) of the Indian Patents Act that the Claims fall within the scope of section 3(e) of the Patent (Amendment) Act, 2005, as it appears that the claimed composition is obtained by mere admixing of the constituents resulting only in the aggregation of their properties.
As a response, Applicant submitted that u/s 3(e) that the claimed composition of the presently amended claims is not a mere admixture of the properties of the individual components rather it demonstrates unexpected synergy.
