As a response to the said objection, the Applicant submits that the compound of the present invention is innovated after extensive experimentation done by the Applicant; therefore, they are not mere discovery of new form of known substance. Section 3(d) is applicable to only those inventions which are mere discovery of new forms of the known substance, and the “form” is defined by the explanation in the Section. The Applicant respectfully submits that the compound of formula (1) of the presently amended claim is novel and therefore not previously known in the prior art. It is submitted that in the cited prior arts, there is no direct, clear and unambiguous disclosure of the claimed compounds.
