As per patent office journal dated 30/07/2021, patent number 372411 has been granted to SCHNEIDER ELECTRIC IT CORPORATION, which is titled DATA CENTER CONTROL. The primary independent claim of this patent states a computer implemented system and method for data center control that identifies parameters of one or more data centers. Further, the systems and methods receive a command to execute an application, and identify a selected data center from the one or more data centers as a location to run the application based at least in part on an evaluation of the parameters and evaluates the parameters to identify an underutilization condition of a device of one of the data centers; and disables the device of the one of the data centers based on the underutilization condition.
During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that the present invention is not a computer program per se and also provides a technical effect which is technically advanced over the known arts. Furthermore, the applicant respectfully submits that the construction of the claims of the instant invention is in accordance with the provisions of the Indian Patents Act, CRI guidelines issued in respect of the patentability of computer related inventions and the Delhi High Court judgment in the Ericsson vs. LAVA case. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
