The primary independent claim of this patent states a method for monitoring quality of software tools, the method being executed by a processor, the method comprises receiving, by an issue tracking module, an input indicative of an issue with at least one software tool, wherein the issue is indicative of a problem faced by a user while utilizing a functionality provided by the at least one software tool and ascertaining, by an analysis module, whether the issue is a data related issue, wherein the ascertaining comprises analyzing the issue based on pre-configured rules retrieved from application support rules, and wherein the data related issue comprises one or more of invalid data, incorrect format of data, junk values in data, incorrect file attributes, incorrect permissions to access a file, and data duplication. Subsequently, determining, by the analysis module, if the issue is a change request, on ascertaining the issue to be a data related issue, wherein, on determination that the issue is a change request, generating a report indicative of an impact of the change request on at least one process associated with the at least one software tool; and resolving, by the analysis module the issue based on the analyzing, wherein the resolving comprises generating patches based on the preconfigured rules retrieved from the application support rules.
During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that if the present invention provides a technical solution to a technical problem and has a technical effect then the same cannot be considered to fall under the category of algorithm or computer program per se. In the light of such observation, the features of the claimed invention provide a technical solution to a technical problem i.e., how to reduce the time and costs involved in the monitoring of quality of software tools. The technical effect of the claimed subject matter lies in analyzing whether the issue is a data related issue and then analyzing whether the data related issue is a change request, and then subsequently generating a report based on impact of change request within the software tool. Therefore, the claims of the present invention do not fall within the scope of Section 3(k) of the Act.
