As per patent office journal dated 09/07/2021, patent number 371130 has been granted to GILEAD SCIENCES, INC, that is titled POLYCYCLIC CARBAMOYLPYRIDONE COMPOUNDS AND THEIR PHARMACEUTICAL USE. The primary independent claim of this patent states a compound of Formula having the structure including stereoisomers or a pharmaceutically acceptable salt thereof.
During the patent prosecution, the patent examiner objected to this patent under section 3(d) of the Indian Patents Act. The patent applicant responded to this objection by stating that the compound of the invention W is -CHZ2 -, Zl and Z2 are taken together to form L, and either L is C(Ra )2C(Ra )2- and Z4 is -CH2-, or L is -C(Ra )2- and Z4 is -CH2CH2-, wherein in both instances each Ra is hydrogen. Further, the claimed compound contains a trifluoro-substituted aryl ring. Moreover, the claimed compound has a different three-dimensional conformation and distinct pharmacological properties that have not been disclosed in any prior art and does not recite mere use of a known substance instead results in enhancement of known efficacy. Therefore, the claimed invention does not fall under the purview of 3(d) of the Patents Act.
