Patent granted in India to Siemens Mobility GmbH

As per the patent office journal dated 09/07/2021 patent number 371018 has been granted to Siemens Mobility GmbH, which is titled METHOD FOR ACQUIRING DATA TRANSMITTED IN A COMPUTER NETWORK COMPRISING AT LEAST ONE COMPUTER AND DATA ACQUISITION ARRANGEMENT. The primary independent claim of this patent states a method for acquiring data transmitted in a computer network. The method includes the transmission of data from a computer to an auxiliary computer. Further, the transmitted data is tapped and passed to a data acquisition device. In other words, the method includes the data transmission that has been previously received or sent from at least one computer to the auxiliary computer after repackaging.

During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that the claims of the present invention do not fall under the category ‘algorithm’ instead relates to an efficient method of data transmission. Thus, having technical nature and technological advancement over the method known in the art. Therefore, the claims of the present invention do not fall under the purview of section 3(k) of the Patents Act.
