During the patent examination, the patent examiner raised objections under Section 3(d) of the Indian Patents Act stating that the composition under the claims comprises a new combination of known substances that are not patentable without efficacy.
As a response, the Applicant submitted that the claimed invention comprises of an oral fast dissolving pharmaceutical composition made up of lornoxicam or pharmaceutically acceptable salts thereof, one alkalinizer, one organic acid, and pharmaceutically acceptable excipients selected from the group consisting of disintegrants, preservatives, colors, antioxidants, sweeteners, flavoring agents, emulsifiers, binders, glidants, and lubricants, wherein the weight ratio of lornoxicam to alkalinizer is in the range of from 1: 43 to 1: 85 and the weight ratio of alkalinizer to an organic acid(s) are in the range of from 3: 1 to 100: 1, wherein at least 30 % of lornoxicam is released from said composition within 3 minutes and at least 40 % of lornoxicam is released from said composition within 10 minutes.
