As per patent office journal dated 06/08/2021, patent number 373405 has been granted to INTEL CORPORATION, which is titled CONTROLLED ACCESS TO FUNCTIONALITY OF A WIRELESS DEVICE. The primary independent claim of this patent states an apparatus, having electronic devices including a processor, a memory, and a camera. The electronic device obtains a first biometric measurement of a part of a person’s body; present a prompt, comprising an image of a particular physical change comprising a change in a facial expression of the person, on a touchscreen of the electronic device to prompt the particular physical change in at least part of the face of the person, wherein the particular physical change is unpredictable to avoid anticipating the particular physical change. Further, obtain a second biometric measurement of the at least part of the face of the person subsequent to the presentation of the prompt is obtained and verified that the second measurement is different than the first measurement and confirm that the second biometric measurement reflects the particular physical change, to determine that the second biometric measurement is from a living person corresponding to the person.
During the patent prosecution, the patent examiner objected to this patent under section 3(k) of the Indian Patents Act. The patent applicant responded to this objection by stating that the claims have been amended as directed and therefore, the subject matter is directed to an apparatus to perform biometric authentication and not to computer programs per se. Therefore, the present invention does not fall under section 3(k) of the Patents Act.
