During the patent examination, the Patent Examiner raised objections under Section 3(k) of the Patents Act, 1970 stating that the Claims relate to a system, wherein instead of claiming the hardware features mere functional features have been defined/ disclosed. For instance, the components disclosed in claims, a processing unit, and a memory unit, are known hardware features. As worded the inventive feature, if any, appears to lie in the software application which enables the system to function in an intended manner. In other words, the claimed system is a conventional one with software applications loaded in the memory which when executed performs the said method.

As a response, the Applicant submitted that the amended claims do not recite any feature that relates to a computer program per se or algorithms. Rather, the claims recite technical acts and components that give effect to the technical act of accurately extracting data from media application rendering. The claims when construed as a whole provide for a technical contribution over the state of the art, in that, the claimed technical elements in combination with the specified functionalities provide for accurately extracting data from media application renderings through the identification of a digital construct (metadata) and condition-based extraction of the metadata, as required by the amended claims.
